Kenya’s personal income tax operates on a progressive scale under the Income Tax Act. For the 2024/2025 tax year, the monthly brackets are: the first KES 24,000 taxed at 10%; KES 24,001 to KES 32,333 taxed at 25%; KES 32,334 to KES 500,000 taxed at 30%; KES 500,001 to KES 800,000 taxed at 32.5%; and above KES 800,000 taxed at 35%. A monthly personal relief of KES 2,400 applies to all resident employees. Africa Deployments Kenya applies the current KRA tax tables to every payroll run.

The National Social Security Fund (NSSF), governed by the NSSF Act No. 45 of 2013, provides retirement and social security benefits for employees in Kenya. Contributions are calculated on a tiered basis: Tier 1 applies 6% to pensionable earnings up to the Lower Earnings Limit of KES 9,000 (maximum KES 540 per party per month), and Tier 2 applies 6% to pensionable earnings between KES 9,000 and the Upper Earnings Limit of KES 108,000 (maximum KES 5,940 per party per month), giving a maximum combined NSSF contribution of KES 6,480 per party per month. The Social Health Authority (SHA) was established under the Social Health Insurance Act 2023, replacing the National Hospital Insurance Fund (NHIF). SHA administers the Social Health Insurance Fund (SHIF), to which employees contribute 2.75% of their gross monthly salary. Employers deduct and remit SHIF contributions on behalf of employees each month. Africa Deployments Kenya manages SHA registration, monthly SHIF deductions, and remittance for every employee under our EOR arrangement, using the current SHA terminology and contribution rates, not the old NHIF framework.

The National Industrial Training Authority (NITA) levy is a monthly statutory contribution payable by all registered employers in Kenya, governed by the Industrial Training Act. The levy is currently KES 50 per employee per month and is remitted to NITA to fund workplace skills development and industrial training programmes across Kenya. Africa Deployments Kenya collects and remits the NITA levy as part of the full monthly payroll service for every employer operating in Kenya through our EOR arrangement.

The Affordable Housing Levy (AHL) was introduced under the Affordable Housing Act 2024. Both the employer and the employee each contribute 1.5% of the employee’s gross monthly salary to the levy, which funds Kenya’s national affordable housing programme. Africa Deployments Kenya calculates, deducts the employee portion, and remits both the employer and employee portions of the Affordable Housing Levy to the Kenya Revenue Authority as part of the standard monthly payroll run.

The Work Injury Benefits Act 2007 (WIBA) requires all employers in Kenya to provide compensation to employees who suffer occupational injuries or diseases in the course of their employment. Employers must either obtain WIBA insurance through an approved insurer or demonstrate financial capacity to meet compensation obligations. WIBA is administered by the Directorate of Occupational Safety and Health Services (DOSHS) and replaced the earlier Workmen’s Compensation Act. Africa Deployments Kenya manages WIBA compliance and insurance coverage as part of the full EOR arrangement for every employee.

Under the Employment Act 2007, the maximum ordinary working hours in Kenya are 52 hours per week for employees engaged in work involving physical effort, and 45 hours per week for office and other non-manual workers. Overtime must be agreed in advance and compensated at one and a half times the employee’s ordinary hourly rate, or at double the ordinary rate for work performed on rest days and public holidays. Kenya’s minimum wage is set by the Minister for Labour through the Regulation of Wages (General) Order and varies by occupation, skill level, and location. The minimum wage for unskilled workers in Nairobi and other major urban centres is reviewed annually and adjusted by gazette notice. Employers must comply with the applicable minimum wage for each employee’s job category and location. Africa Deployments Kenya ensures all employment contracts and payroll runs meet the current Kenyan minimum wage requirements and any applicable sectoral wage orders.

Under the Employment Act 2007, employees in Kenya are entitled to a minimum of 21 working days of paid annual leave for every 12 months of continuous service, accruing at 1.75 days per month worked from the first day of employment. Annual leave must be granted within 12 months of the end of the leave cycle. Unused annual leave at termination must be paid out in full as part of the final settlement. Africa Deployments Kenya calculates and manages annual leave accrual and terminal pay as standard.

Female employees in Kenya are entitled to three months of fully paid maternity leave under the Employment Act 2007, with the employer bearing the full salary cost during this period. Male employees are entitled to two weeks (14 calendar days) of fully paid paternity leave. Both maternity and paternity leave entitlements apply from the first day of employment and are fully managed by Africa Deployments Kenya as part of the EOR arrangement, with no cost or administrative burden on the client.

Under the Employment Act 2007, employees in Kenya are entitled to up to 30 days of paid sick leave per leave cycle after two months of continuous service, followed by a further 15 days of sick leave at half pay. All sick leave must be supported by a valid medical certificate issued by a recognised medical practitioner. Africa Deployments Kenya manages sick leave administration, payslip adjustments, and compliance with the Employment Act 2007 sick leave provisions for all employees under the EOR arrangement.

Notice periods in Kenya are governed by the Employment Act 2007. The minimum statutory notice period is determined by the employee’s basis of payment: 28 days for monthly-paid employees; two weeks for fortnightly-paid employees; seven days for weekly-paid employees; and 24 hours for daily-paid employees. Employment contracts may provide for longer notice periods. Africa Deployments Kenya manages all notice period obligations, issues compliant termination notices, and coordinates the full offboarding process for employees under the EOR arrangement.

Severance pay in Kenya is triggered exclusively in cases of redundancy under the Employment Act 2007 and does not apply to resignations or dismissals for misconduct. Employees made redundant are entitled to a minimum of 15 days’ basic pay for each completed year of continuous service. Severance is calculated on the employee’s basic pay at the time of redundancy. Yes. Fixed-term employment contracts are permitted under the Employment Act 2007 in Kenya and must specify the contract duration, the nature of the work, and the terms of renewal or non-renewal. A succession of fixed-term contracts for the same role without justifiable reason may, over time, be deemed by the Employment and Labour Relations Court to constitute permanent employment.
