Kenya EOR pricing is typically structured as a monthly management fee per employee, covering the full Employment Act 2007-compliant employment relationship: contract drafting, KRA PAYE registration, NSSF Tier 1 and Tier 2 contributions, SHA/SHIF deductions, Affordable Housing Levy, NITA levy, WIBA coverage, HR administration, and payroll processing. The fee is separate from statutory employer contributions, which are passed through at cost. Africa Deployments Kenya provides transparent pricing with no hidden intermediary markup on statutory costs.

Kenya statutory employer costs that form part of the total employment cost include: NSSF Tier 1 and Tier 2 employer contributions (maximum KES 6,480 per employee per month at the 2025/2026 Year 4 rate), Affordable Housing Levy at 1.5% of gross salary, and WIBA insurance premiums. The NITA levy (KES 50 per employee per month) and SHA/SHIF deduction (2.75% of gross salary, minimum KES 300) are employee-side obligations managed by the employer. Africa Deployments Kenya includes all statutory cost management in the full EOR fee.

There are no hidden fees for ELRC compliance, contract renewals, or standard employment documentation.

Incorporating a local subsidiary in Kenya through the Business Registration Service (BRS) typically requires a setup investment of $50,000 and above when accounting for legal fees, BRS registration, KRA PIN and NSSF employer registration, local HR and payroll hires, office setup, and ongoing compliance costs. The process takes six to twelve months before the first employee can be legally employed. Africa Deployments Kenya’s EOR model eliminates all setup costs and enables employment within 48 hours, with full Employment Act 2007 and KRA compliance included from day one.

Statutory contributions including NSSF employer contributions, the Affordable Housing Levy employer portion (1.5% of gross salary), and WIBA premiums are employer costs that are additional to the ADS Kenya management fee and are passed through to the client at their actual statutory amount with no markup. SHA/SHIF (2.75% of gross salary, minimum KES 300) and the employee portion of the Affordable Housing Levy (1.5% of gross salary) are employee-side deductions that Africa Deployments Kenya calculates and remits to the KRA on behalf of the employer at no additional charge.

The Social Health Insurance Fund (SHIF), established under the Social Health Insurance Act 2023 and administered by the Social Health Authority (SHA), replaced the National Hospital Insurance Fund (NHIF). The current employee deduction rate is 2.75% of gross salary per month, minimum KES 300. There is no employer contribution counterpart. Providers marketing Kenya EOR services that still reference NHIF contribution rates are applying superseded legislation. ADS Kenya applies the SHA/SHIF rate from the Social Health Insurance Act 2023.

For organisations with fewer than ten employees, or those in a market-testing phase, the total cost of incorporating a Kenya subsidiary plus ongoing monthly compliance management (payroll, KRA filings, NSSF/SHA registrations, company secretarial obligations) typically exceeds the ADS Kenya EOR service fee in Year 1 by a material margin. A local entity becomes more cost-competitive at scale, typically with sustained headcounts of 20 or more employees and a confirmed long-term Kenya commitment. ADS Kenya can advise on the crossover point based on your specific headcount and compensation levels.

The ADS Kenya flat monthly fee per employee covers: compliant employment contract drafting, monthly payroll processing in Kenyan Shillings, Form P10 PAYE filing with the KRA via iTax, NSSF and SHA/SHIF remittance, Affordable Housing Levy and NITA levy remittance, annual Form P9A issuance and Form P10A reconciliation, leave administration, WIBA compliance advice, and Section 40 Employment Act-compliant separation management. There are no separate charges for statutory filings. Work permit applications for foreign employees are quoted separately.

Work permit application support for foreign employees (Class D permit under the Kenya Citizenship and Immigration Act) is quoted separately from the EOR service fee. The government-assessed issuance fee for a Class D work permit is KES 500,000 per year; this passes through at cost with no ADS Kenya margin applied. EAC member state nationals may qualify for exemption from this fee. ADS Kenya advises on permit eligibility and coordinates documentation for all foreign employees placed on the Bergmont Employer of Record Limited payroll.
