The Work Injury Benefits Act 2007 (WIBA) requires all employers in Kenya to compensate employees for occupational injuries and diseases sustained in the course of employment. Employers must hold WIBA insurance through an approved insurer or demonstrate the financial capacity to meet compensation obligations directly. WIBA is administered by the Directorate of Occupational Safety and Health Services (DOSHS) and replaced the earlier Workmen’s Compensation Act. The National Industrial Training Authority (NITA) levy is a statutory monthly contribution of KES 50 per employee, payable by all registered employers in Kenya under the Industrial Training Act. Under the Employment Act 2007, the maximum ordinary working hours in Kenya are 52 hours per week for employees engaged in work involving physical effort, and 45 hours per week for office and non-manual workers. Overtime is capped and must be agreed in advance, compensated at one and a half times the ordinary hourly rate, or at double the ordinary rate for work on rest days and public holidays. Under the Employment Act 2007, employees in Kenya are entitled to a minimum of 21 working days of paid annual leave per 12-month leave cycle, accruing at 1.75 days per month of continuous service from the first day of employment. Annual leave must be granted within 12 months of the end of the applicable leave cycle. Unused annual leave at termination must be paid out in full in the final payroll settlement. Female employees in Kenya are entitled to three months of fully paid maternity leave under the Employment Act 2007, with the employer bearing the full salary cost during this period. Notice periods for termination in Kenya are governed by the Employment Act 2007. The minimum statutory notice period depends on the basis of payment: 28 days for monthly-paid employees; two weeks for fortnightly-paid employees; seven days for weekly-paid employees; and 24 hours for daily-paid employees. During a probationary period of up to six months (extendable by agreement to 12 months), shorter notice periods may apply as specified in the contract. Severance pay in Kenya is governed by Section 40 of the Employment Act 2007 and applies exclusively to redundancy, not to resignation, expiry of a fixed-term contract, or dismissal for misconduct.
